Football and Netball Club Members Nomination Terms & Conditions

• The Warralily at Armstrong Creek “Football and Netball Club Members Nomination Promotion” (promotion) commences at 8.00am (AEST) on Monday 2nd April 2012 and ends at 4.00pm (AEST) on 31st December 2013 (AEST) (promotion period).
• Information on the promotion, Benefits and eligibility are set out in these terms and conditions. Entry into this promotion is deemed to be acceptance of these Terms and Conditions.
• All available lots are eligible as part of this promotion and at the time of the referral must adhere to these terms and conditions, and not already;
  • Be the subject of a holding deposit prior to Monday 16th May; or
  • Be the subject of a contract of sale prior to Monday 16th May.
• This Promotion is open to any Club who has a member (or direct family member including mother, father, brother or sister of the club member) nominate that Club to Warralily at Armstrong Creek when purchasing an available lot of land during the promotion period by filling out the “Warralily Football and Netball Club Members Nomination Form”.
• Subject to these Terms and Conditions including but not limited to satisfaction by the Applicant of item 6 of these Terms and Conditions, Armstrong Creek Development Corporation Pty Ltd (69 950 765 305) offers to provide a donation voucher to the value of A$500 to the Club as nominated by the purchaser.
• A Club will be entitled to receive a donation if:
  • The purchaser nominating the club subsequently enters into a binding unconditional contract of sale for the purchase of an available Lot during the promotion period;
  • The Nominating Purchaser submits a fully completed Nomination Form to the Sales Consultant which has been signed by the purchaser at the time of signing the Contract of Sale;
  • The Sales Consultant acknowledges that they have accepted the nomination by signing the Nomination Form that has been signed and approved by the relevant club representative confirming the purchaser’s membership with that club.
  • The Contract of Sale is unconditional and a full 10% deposit has been paid.
• If a completed Nomination Form has not been received by the Sales Consultant at the time when the Nominating Purchaser enters a Contract of Sale, no Benefit will be given to the Nominator for a Club nomination.
• Only 1 (one) Club may be nominated for each available lot of land purchased. A purchaser is entitled to nominate a club for each available lot of land they purchase. A maximum of 3 (three) club nominations for 3 (three) separate lot purchases under the one name in any given 12 month period is allowed.
• The Benefit is not transferable or exchangeable and cannot be taken as cash.
• If, for any reason:
  • any aspect of this Promotion is not capable of running as planned, the Promoter reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the program; or
  • the Contract of Sale is not unconditional and / or the 10% deposit has not been paid in full in accordance with the terms of the Contract of Sale, the nominated Club will not be entitled to receive the Benefit; or
  • the Benefit is not available, the Promoter reserves the right but not the obligation to substitute the Benefit for another similar item, at is sole discretion, of equal value.
• The Promoter accepts no responsibility for any tax implications that may arise from the receipt of any Benefit by the Referrer. Referrers should seek independent financial advice if concerned.
• The Promoter may not be sued in any capacity other than as the trustee for the Trust, including seeking the appointment of a receiver (except in relation to property of the Trust), a liquidator, an administrator or any similar person to the Promoter or prove in any liquidation, administration or arrangement of or affecting the Promoter (except in relation to property of the Trust).
• The Benefit will be paid as a donation in the form of a cheque to the Club nominated on the Nomination Form and will be presented to the club at the expiration of the football / netball season (subject to the Contract being unconditional and the full 10% deposit being paid).
• The following capitalised words in these Terms and Conditions have the following meanings:
  • Nomination Form means the document titled “Warralily Football and Netball Members Club Nomination Form” a copy of which is attached as Annexure 1 to these Terms and Conditions
  • Nominating Purchaser means a purchaser of an available Lot whether as an individual or group of individuals, each 18 years of age and over who has then nominated a club within Football and Netball Geelong who is to receive the $500 donation in accordance with these terms and conditions.
  • Club means the sporting organisation that participates in the Football and Netball Geelong leagues who is nominated by a football and netball Geelong member of the club so that the club may receive the A$500 donation from Armstrong Creek Development Corporation. A list of eligible clubs can be found at Annexure 2.
  • Warralily at Armstrong Creek means the development project being carried out by Armstrong Creek Development Corporation Pty Ltd on the land situated at 259 Charlemont Road, Connewarre 3227 and extending through to Surf Coast Highway, Mt Duneed.
